BMP Wins Significant Trade Secret Case in South Texas

A Laredo, Texas jury has returned an important verdict for the clients of Beirne, Maynard & Parsons, L.L.P. in Cause No. 2008-CVF-000353D1; Vaquillas Energy Ltd., et al vs. Thomas A. Lamont et. al., In the District Court, 49th Judicial District, Webb County, Texas.

 

After a 3 week trial, BMP lawyers Jeff Parsons, Joe Cohen, and Brannon Dillard obtained the victory for Firm clients Vaquillas Energy Lopeno Ltd. and JOB Energy Partners II Ltd. (“Plaintiffs”) against LOG Energy Development, Ltd., Montecristo Energy II, Ltd., Thomas Lamont, and Rosendo Carranco (“Defendants”). 

 

The jury’s verdict found that Defendants misappropriated Plaintiffs’ trade secrets, tortiously interfered with Plaintiffs’ contracts, caused millions of dollars of damages to Plaintiffs, and did so as part of a civil conspiracy. The jury verdict contains two measures of damages: Defendants’ profits of $6.1 million and Plaintiffs’ lost profits of $4.9 million. BMP has moved for judgment on the higher award.

 

The case has significance for intellectual property law, and the oil and gas industry, as it involves seismic interpretive maps and their trade secrets, and the rights of parties who contract for the generation of oil and gas prospects.
