Senator Birdwell Defeats Eligibility Challenge

Beirne, Maynard & Parsons, a Houston-based civil litigation defense firm, successfully represented State Senator Brian Birdwell after his status as a resident of the State of Texas for purposes of meeting the constitutional requirements to hold his office was challenged in an original mandamus proceeding. The Fifth Court of Appeals in Dallas held that State Senator Brian Birdwell is eligible to continue to seek his seat in the Texas Senate.
Ruling largely on Texas election law, the court affirmed Senator Birdwell's position that the claims asserted by The Texas Democratic Party do not conclusively prove that he is not a resident Texas. Specifically, the court "...conclude[d] the 'records' relied upon by realtors...do not conclusively establish Birdwell is an ineligible candidate for the Texas Senate."
